Court quashes Abraham Chol sentence after Mercy appeal

The lawyer representing Prophet Abraham Chol says his client was discharged after the Court of Appeal accepted his Mercy request.


Abraham Chol was freed on Wednesday and his sentence was quashed four months before its end.

The 55-year-old was sentenced in December last year after being charged with subverting a constitutional government and causing disunity among the organised forces.

He was arrested along with four others in July 2021, after prophesying that President Kiir and his first deputy Riek Machar would be ousted on the independence day anniversary of that year.

In his statement after releasing Chol yesterday, his lawyer says

“In the beginning, we tried to file an appeal but AbrahamĀ  Chol rejected the idea,” his lawyer Warnyang Kiir said.

Warnyang said the Mercy appeal was eventually submitted on January 5, 2023, although the public Prosecution objected to it.

“An appeals court was formed to look into the case on the twenty-eighth of March, and it issued the following decisions, striking off the appeal of the Public Prosecution against the other four defendants for lack of any connection to the case.”

“Acceptance of the request for Mercy in form and content and the sufficiency with a period of his imprisonment since the eighth of July in the year 2021.”

The court then ordered the release of Chol and the recovery of his exhibits.
