Family decries revocation of adultery case against Aweil youth leader

A family in Aweil has decried a court decision to allegedly revoke a court ruling on adultery charges against the youth leader in Northern Bahr el ghazal and alleged that the accused is still hiding the woman.

The concern comes a day after the state police spokesperson told Eye Radio that a public prosecutor dropped adultery charges against Tito Awan Bol.

Captain Guot Guot Akol said the unnamed prosecutor also revoked a warrant of arrest issued against the newly elected youth leader on the 14th of this month.

When contacted over the matter on Tuesday, accused Tito Awan Bol told Eye Radio that the judge found no evidence on his case, citing dismissal of the case.

However, a nephew to Machol Ngong, whose wife Tito allegedly eloped said the court had required Tito to take an oath and stop any affairs with the woman.

According to Dr. Luka Dut Ngong, Tito refused to take the oath, but instead allegedly eloped with the woman again and hid with her in an unknown location, an allegation Tito denied.

“I have to confirm that my uncle is one of the wounded heroes and because of that he’s vulnerable in the village, so after the arrest warrant was issued, Tito was nowhere to be found and the arrest warrant was canceled,” said Luka Dut Ngong.

“The only two reaming things were, Tito has to take an oath that he will never have an affair with the woman again, and he has to stay away from the woman but now he refused to take an oath and he has hidden the woman,

“The attorney was influenced by the lawyer and friends of Tito because what I have heard from the village is that the appeal is acutely taken by the friends,

“The lawyer is someone who knows the law, and he was not able to go and face the attorney and so, he sends two friends to take a memorandum of appeal to an attorney and through that, the attorney was influenced.”

In response, Aweil youth leader, Tito Awan Bol rejected the claim, saying the court has set him free over insufficient evidence.

“All these allegations that are going around against me, came through Dr. Luka, so there’s nothing new about it, all things are rubbish,” said Tito.

“The court of law would have not dismissed all things summarily, and you are given a certificate of dismissal and it means there is no ground of something completely,

“The good thing is, his uncle is a human being, and he is a living person, and his wife is a living person, He [Dr. Luka] can concoct anything behind the scenes against me,

“I am now walking free, I am now in the [Aweil] state house, and if someone could come, they will find me there, and I am doing official duty.”

However, Tito was accused of committing adultery with a woman.

In a document sent to the Eye Radio newsroom, Isaac Deng Athian, the lawyer of the youth leader wrote a Memorandum Criminal Appeal to the Director of the State Legal Administration.

He says the case has been already settled after the accused paid 7 cows as a penalty for committing adultery as per customary court.

Isaac added that the case resurfaced after his client was elected as a youth leader in Northern Bahr el ghazal.

He accused unnamed politicians of inciting the respondent to tarnish the image of his client.

In a document dated 17/10/2022 it read: “The Wanyjok-based prosecution authority issued an arrest warrant on 13/10/2022 for the arrest of my client/Appellant: We arrived at its copy there on and we accepted it for the sake of making an appeal.”

It added that: “The respondent’s wife and the Appellant and other 3 persons were accused by a respondent as having committed an offense of adultery with his wife [Name hidden] in early 2022.”

The document stated that the accused paid 7 cows as a penalty for committing adultery as per customary court.

The cows were paid before Malual-Baal Payam customary court on 21st May 2022, a narrative Tito refused to addmit.

“The Appellant, with his high moral, education and courage, bore the burden of that case unto himself alone and paid 7 cows as “ARUOK” including 1. Nyanyen, 2. Nyanyiel, 3. Nyantuong-wel, 4. Nyantuong-pure, 5. Nyanyom, 6. Machar, and 7. Matuong.” the Memorandum stated.
