Fuel import dispute moves to Supreme Court

The Supreme Court has directed the Court of Appeal to transfer the case file in a dispute involving the government-to-government petroleum import framework between the Ministry of Petroleum and Pacific Petroleum Company Limited.

The dispute concerns a fuel supply arrangement between the governments of South Sudan and Kenya, which Advocates Without Borders argues created an unlawful monopoly over fuel imports into South Sudan.

On Monday, the Court of Appeal expanded its June 23 interim injunction to include the Ministry of Petroleum, Pacific Petroleum Company Limited, Sovereign Energy Oil Trading LLC, Gulf Energy Limited and Skysoar Holding Company Limited.

During the proceedings, the Court of Appeal confirmed that the Ministry of Petroleum had appealed the injunction before the Supreme Court, which requested the case file for review.

The Court of Appeal then directed that the record be transmitted to the Supreme Court in compliance with the request.

The interim injunction remains in force while the Supreme Court considers the appeal and is expected to determine the issues raised by the parties.
