President Salva Kiir may form a partial government without the leader of the leader of the SPLM in opposition, Dr Riek Machar, according to the presidential press secretary.
However, Mr Ateny Wek Ateny did not say when this government will be formed.
Last week, President Salva Kiir appointed the Dr Machar as the First Vice President. He then asked Dr Machar to return to Juba immediately so that they could work together to form the agovernment of national unity within a week.
But the seven-day deadline has elapsed.
A senior member of the SPLM in Opposition on Thursday told reporters that Dr Machar would only come to Juba if security arrangements were fully implemented.
“It’s still the prerogative of the President to continue to form the government of national unity and then leave the positions that are allotted to Riek Machar vacant,” Mr Ateny told Eye Radio.
But the Joint Monitoring and Evaluation Commission and Partners group had advised against a unilateral formation of government.
They include regional countries such as Kenya, Ethiopia, Sudan, Djibouti, and Chad.
Others are China, Norway, the United States, the United Kingdom and the African Union.
In a statement after a meeting in Nairobi on Thursday, they said all the stakeholders to the agreement should participate in the formation of the government.
They said proceeding to unilaterally form a government would undermine the letter and spirit of the agreement.
